Please inspect the cabin upon arrival - if anything is not acceptable please call homeowner within 2 hours of arrival.

 

Check-out: 10:00 AM. 

Before you leave, please:

•Clean and return dishes, cups, and utensils to cabinets and drawers

•Place towels in laundry bag

•Make sure oven and burners are off

•Take trash to the outside cans

•Turn off lights

•Close windows

•Lock doors

•Leave keys in lockbox

 

Early check-in and/or late check-out MUST be pre-approved.

 

The following SHORT TERM RENTAL AGREEMENT must be agreed to rent the cabin

 

         This Short Term Rental Agreement (the “Agreement”) is made by and between _______________ (“Homeowner”) and _____________ (“Guest”) as of the date set forth on this Agreement.  For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

 

1.  Property:  The Property is located at: 24 Oak Lane, Lake George, NY 12845. The Property is furnished and rental includes use of the entire Property and all amenities. For the entrance to Oak Lane, use the corner of Flat Rock Road and Oak Lane, where the Sprucewood Hotel sign is located. For GPS, the road entry address is 3329 Lake Shore Dr., Lake George, NY 12845.

 

2.  Term:  The term begins at 3 PM on the “Check-in Date” and ends at 10 AM on the “Check-out Date” unless otherwise agreed in writing.

 

3.  Use:  The Rental Party shall consist of Guest and up to three (3) additional persons unless otherwise agreed in writing. All persons are obligated to abide by the terms of this rental agreement, including the Rental Rules. People other than those in the Rental Party set forth above may not stay overnight in the Property. At no time no more than eight (8) persons in total be present on the Property. Any person in or on the Property is the sole responsibility of Guest and by accepting this reservation, it is agreed that the Guest is expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. If more than the maximum number is found to be present or occupying the Property, this Agreement may be immediately terminated without refund and any Security Deposit paid may be forfeited. Any overcrowding, large parties, or misrepresentation is cause for immediate evection and forfeiture of all payments.

 

4.  Rental Rules:  Guest agrees to abide by the Rental Rules at all times while at the Property and shall cause all members of the Rental Party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.

a.   Guest and any additional permitted guests shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property; keep the Property in clean and sanitary condition at all times; refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, nor commit waste or nuisance on or about the Property.

b.  If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately.

c.   Guest shall refrain from excessive noise or activities that are disruptive to the neighboring properties. Quiet times (no outside amplified noise) from 9 PM to 8 AM.

d.  In the event that police or other authorities are notified of noise or other complaints, this Agreement may be immediately terminated with no refund to Guest. If there is a complaint of excessive noise or overcrowding, Homeowner may inspect the property without notice.

e.   Smoking is allowed outside only and all trash (butts) must be disposed of safely.

f.        Pets of any kind are not allowed on the Property.

g.  Beach: The beach is an association shared beach that closes at dusk. There is no lifeguard. Rental Party agrees to follow the beach rules that are posted at the beach and all use is entirely at the Guest’s own initiative, risk and responsibility. No fishing allowed.

h.  Heat and Air Conditioning: The Property has electric baseboard heat and stand-up portable air conditioners.   

i.        Fireplace and Fire Pit: The fireplace is NOT in use, use only the electric log / heater. Use the outside fire pit at your own risk, Homeowner is not liable for injury or destruction of property from misuse. Ashes may be left in the fire pit or placed in the steel can by the shed once cooled for at least 24 hours. It is the guest responsibility to be informed of local fire bans (usually mid-March to early-May) and to ensure safe usage of this equipment. Guest acknowledges that use of the fire pit may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children, and such use is at the Guest’s own risk.

j.        Fireworks of any nature whatsoever are strictly prohibited.

k.  Water: the cabin is on well water. The water is potable, not chemically treated.

l.        Septic: the cabin uses a septic system. The septic system is sensitive and may be damaged if improper material is flushed, Guest agrees to only flush the supplied rapid dissolve toilet paper. If it is found that incorrect products have been flushed, Guest may be charged an additional $300 for a septic pump out.

m. Trash collection: Please use supplied garbage bags, tie tightly and place inside either of the two large garbage cans outside and secure the lid. If the outside garbage is full, inform Homeowner to have the garbage collected.

n.  Recycling: All plastic, glass, paper and metal can be placed in a clear trash bag. All items must be clean and can be left in the cabin or stored in the shed.

o.  Recreational vehicles, campers and/or tents are prohibited.

p.  Security cameras: two are outside, disconnected, only used off season.

q.  At the end of the rental period, the Property must be left by Guest in a neat, sanitary and habitable condition.

Failure to follow these Rental Rules or Use restrictions may result in evection without refund, additional charges for damages, and/or forfeiture of the Security Deposit.

5.  Pets and Service Animals: Pets are not allowed. Emotional support animals, therapy, comfort, or companion animals are not considered a Service Animal in NY, they are considered a Pet. Service Animals are allowed if the following questions are answered: 1) is the animal required because of a disability; and 2) what work or task has the animal been trained to perform. Guest will provide Homeowner these answers in writing prior to approval of this Agreement. If a Pet is brought to the Property, this Agreement may be immediately terminated, with no refund to Guest and an additional cleaning fee of $500 may be charged. In the event that extraordinary cleaning is required or there are damages from animals, additional charges may be charged as documented by Homeowner.

 

6.  Rental Fee: Acceptable payment methods for the Rental Fee include cash, personal check, third Party processors (AirBnB, VRBO) or as otherwise agreed with Homeowner. Payment is due according to Appendix A and the Property will be reserved only upon receipt of Payment and signed Agreement. Payment of the Rental Fee constitutes acceptance of this agreement.

 

7.  Damages: Guest will be responsible for all damage and/or loss to the property that occurs during the stay and is liable for damages due, but not limited to, the following: 1) intentional, willful, reckless, or malicious acts of the Guest or others at the property during the tenancy; 2) damage by Pets or Service Animals; 3) damage caused or occasioned by smoking; 4) theft from the property of either the Homeowner's or property belonging to the Rental Party or others on the Property during the tenancy, where the property was not locked and secured, 5) gross negligence of Rental Party or others on the Property during the tenancy or intentional misuse of furnishings, appliances, equipment, or other amenities provided with the Property; or 6) damages to the Property (e.g. the grounds, grass, etc.) or to personal property by Rental Party or others on the Property during the tenancy.

 

8.  Security Deposit: A Security Deposit may be due according to Appendix A.  The Security Deposit may not be enough to cover all damages and if it is found the Rental Rules or above items were not followed, Guest may be charged for damages beyond the Security Deposit. The Security Deposit shall be refunded within seven (7) days of the Checkout Date provided no deductions are made due to damage to the Property or furnishings, any required excessive cleaning, or any other cost incurred by Homeowner solely due to Guest’s stay.

 

9.  Refunds: Refunds are at the sole discretion of the Homeowner, including mechanical failures of, but not limited to, air-conditioners, fans, washer/dryer, TV, DVD, coffee maker, microwave, internet or other amenities; however, every effort will be made to have repairs made as quickly as possible. Refunds for failures of the stove, refrigerator, water or plumbing systems will be calculated on a case-by-case basis.

 

10.  Cancellation:  If Guest wishes to cancel his/her reservation, the Security Deposit shall be refunded. Host is under no obligation to refund the Rental Fee but may do so if a suitable replacement rental is secured or as otherwise agreed in writing.

 

11.  Insurance:  Homeowner encourages all Guests to purchase traveler insurance. Some insurance included or purchased on third party websites (such as AirBnB, VRBO) may not be sufficient and may not provide sufficient coverage. Homeowner agrees to carry property and liability insurance.

 

12.  RISK OF LOSS AND INDEMNIFICATION: Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Homeowner shall not be responsible or liable for any reason whatsoever. Guest hereby covenants and agrees to indemnify and hold harmless Homeowner and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorney’s fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property and Guest expressly agrees to save and hold Homeowner harmless in all such cases.

 

13.  DEFAULT: If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Property, remove all Guest’s property and belongings, and leave the Property in good order and free of damage. No refund of any portion of the Rental Fee or Security Deposit shall be made and if any legal action is necessary, Homeowner shall be entitled to reimbursement from Guest for all additional costs incurred.

 

14.  ASSIGNMENT OR SUBLEASE: Guest shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or guests of the Guest and included within the number of and as permitted occupants under this Agreement.

 

15.  RELEASE: Guest hereby waives and releases any claims against Homeowner, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guest on or near or adjacent to the Property or beach facilities. Guest agrees to use all facilities or amenities entirely at the Guest’s own initiative, risk and responsibility.

 

16.  ENTRY AND INSPECTION: Homeowner reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or showing the Property to authorized persons.  If Homeowner has a reasonable belief that there is imminent danger to any person or property, Homeowner may enter the Property without advance notice.

 

17.  UNAVAILABILITY OF PROPERTY: In the event the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of Homeowner, Homeowner shall immediately Refund payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Homeowner shall have no further obligations or liabilities in any manner pertaining to this Agreement. If Guest has already Checked In, the refunded amount shall be pro-rated according to the number of dates remaining in the Term of this Agreement.

 

18.  GENERAL PROVISIONS: This Agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both the Guest and the Homeowner. This Agreement shall be governed by the laws of the State of New York. The words “Homeowner” and “Guest” shall include their respective heirs, successors, representatives.  The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waver of that or any other provision in any subsequent breach thereof.  If any provision herein is held invalid, the remainder of the Agreement shall not be affected.  Any notice required to be given under this Agreement shall be in writing.
